Agreement with the Asociación Colombiana de Derecho Penal Empresarial -ASCOLDPEM
Logotipos de ASCOLDPEM, Asociación Colombiana de Derecho Penal Empresarial, y CEA Digital Law Dr. Antonio Tejeda Encinas and Dr. Hoover Wadith Ruiz Rengifo, President and Executive Director of the Asociación Colombiana de Derecho Penal Empresarial (Colombian Association of Corporate Criminal Law, Ascoldpem), sign a collaboration agreement with CEA Digital Law. A great master and expert in Compliance, Dr. Hoover works at Ascoldpem on corporate criminal liability, and he tells us that once the criminal liability of legal persons is recognized in Colombia, which he hopes will be soon, the need for criminal compliance programs for such entities will emerge. It is one of the most exciting intellectual legal challenges for Colombia and, without doubt, one of the most far-reaching developments in Colombian Criminal Law, which will break the routine of well-known concepts, mostly imported, and of the notions that have been used to explain the theory of individual crime as human action. The recognition of the criminal liability of legal persons marks the end of the principle societas delinquere non potest in a hypermodern world where companies play a central role. A paradigm shift. A cutting-edge proposal. The criminal liability of legal persons and the requirement to implement criminal compliance programs in companies place the criminal lawyer in a leading role. For his part, the President of CEA Digital Law, Dr. Antonio Tejeda Encinas, highlights the legal and techno-legal net closing in on any actor involved in the commission of a crime, and this great NETWORK and the Agreement now signed will help all the countries where CEA Digital Law is present, and everyone interested in compliance, to have a point of reference at the Euro-American level, drawing on the good practices already established and observed in the day-to-day implementation and management of technology, which brings new challenges. Thus, for example, compliance with legal regulations also entails compliance with the rules on data management, as well as in other aspects related to the digital world. Techno-digital regulatory compliance demands and requirements are of the utmost importance, not only from a legal standpoint but also from a computing standpoint. In this way we can offer our members and society at large an approach that is close to and tailored to their needs, going beyond the mere legal implementation of new technologies aimed at closing compliance gaps, and also focusing on study and research, as well as on training. Our members from the field of computer engineering, such as universities, professional associations and other bodies of the same nature, will also be a key element in the triangulation proposed here, which CEA Digital Law can offer with the collaboration of all of us, without exclusion.
