From Senegal, a viewpoint published on 31 October 2026 by OSIRIS (Observatoire sur les systèmes d’information, les réseaux et les inforoutes au Sénégal) asks what would happen at local banks and fintechs. The Euro-American Committee of Digital Law – CEA Digital Law sets out its ideas here and places them alongside the European framework.

What is known about the incident

According to reporting of 30 October 2026, Binance disclosed an incident affecting about $6.3bn in assets, of which nearly $3bn had been frozen on-chain. The platform said its initial investigation pointed to a compromised DevOps engineer’s laptop, which may have allowed access to a service container and the submission of unauthorised withdrawals. It later said it had found further points of breach, and that there was no evidence of a private key leak. It undertook to cover losses from its SAFU fund and its own resources.

Stablecoin issuers such as Tether and Circle froze related funds. However, according to Elliptic, the attackers still controlled over $3bn in assets that no issuer can freeze directly. The attribution of the attack to a specific group comes from blockchain analytics firms and has not been established by the platform.

The Senegalese reading: governance before cryptography

The OSIRIS analysis argues that the weakness is above all human and operational: internal access and signing systems, not the cryptography itself. Responsibility therefore reaches the board. It recommends that banks, payment institutions, e-money issuers and fintechs in Senegal and the WAEMU (West African Economic and Monetary Union):

continuously audit credentials, administrator access, validation procedures and workstations;

set decision thresholds, legal bases and chain of custody for digital evidence in advance, so they can act quickly in coordination with the BCEAO;

build blockchain analysis into anti-money-laundering and counter-terrorist-financing programmes, and oversee cloud providers, APIs and subcontractors;

apply Zero Trust, penetration testing, crisis drills and independent review of critical access, and develop local expertise.

Comparison with Europe

These recommendations echo what Regulation (EU) 2022/2554 (DORA) requires of European financial entities: ICT risk management, incident reporting, resilience testing and oversight of critical providers. Directive (EU) 2022/2555 (NIS2) adds governance duties for management. In both, the responsibility of the management body is explicit, which is precisely the point the Senegalese analysis stresses.

Our view at CEA Digital Law

The case confirms that resilience cannot be improvised in the middle of a crisis. Three ideas seem useful for Africa and other regions:

Convergence without copying. The WAEMU need not transpose DORA word for word. It can adopt its principles, such as management accountability, regular testing and control of third parties, through BCEAO instructions scaled to each institution’s size.

Freezing protocols. The speed of issuers shows their value, but also that Bitcoin and Ether fall outside that mechanism. Public-private cooperation frameworks with safeguards would help ensure that acting fast does not mean acting without a legal basis.

Joint drills. Crisis exercises involving banks, fintechs, supervisors and authorities, with lessons shared across Europe, Latin America and the Caribbean, and Africa, would be a low-cost, high-return investment.

One question remains open: how to make these requirements proportionate for small fintechs without stifling innovation or financial inclusion. In our view the answer lies in graduated obligations and shared training and tools.

Sources

OSIRIS, L'affaire Binance : Si un géant de la cryptographie peut être vulnérable, qu'en est-il de nos banques et Fintech au Sénégal ?

The Hacker News, Binance Suffers Security Breach Affecting $6.3 Billion in Assets

Yahoo Finance, Binance hacked for record $6.3 billion

CNBC, $6.3 billion Binance hack is largest crypto theft on record

CEA Digital Law

The Binance attack, affecting about $6.3bn, points to operational and governance weaknesses.
