The statement urges the European Union (EU) to transform itself from a mere ‘regulatory power’ into a bold ‘innovation superpower’. Below, I summarise its key points and then offer my own thoughts and analysis on regulation and innovation.

Summary of the business statement

Ambitious, non-negotiable goals: European business leaders want the EU to pursue long-term goals that are not open to compromise. These include international cooperation, deeper integration, a common defence, disruptive green policies and socio-economic development driven by innovation and technology.

Fair partnerships and critical technologies: The statement stresses the need to establish ‘the right and fair partnerships’ with other regions on critical materials and technologies. This means supporting innovators not only through regulation but also through targeted public and private investment and proactive technology transfer strategies.

Developing talent and retaining professionals: Business leaders call for talent to be developed in Europe, whatever its origin. They also urge that education plans and job opportunities help to retain highly qualified professionals. The aim is to meet future challenges without people having to move abroad.

Business consolidation and European ‘champions’: The statement underlines the need for greater business consolidation across the continent. It also proposes the creation of European ‘champions’ to boost the EU’s competitiveness on the global stage.

Personal reflection

The statement reflects a vision of a more dynamic, innovative and forward-looking Europe. As a lawyer specialising in EU law and digital law, I welcome these efforts and hope that the EU will take concrete steps to become a true innovation superpower. We must, however, consider the role of regulation in this context.

My arguments for and against regulation

For regulation:

– Stability and protection: Rules are essential to guarantee economic stability and to protect citizens and businesses. Without regulation, we could face unfair commercial practices, monopolies and systemic risks.

– Fairness and sustainability: Regulation can level the playing field and ensure that companies compete fairly. It can also promote sustainable and responsible practices from an environmental and social perspective.

Against regulation:

– Innovation and flexibility: Excessive regulation can stifle innovation and creativity. Businesses need room to experiment and to adapt quickly to changes in the market. Overregulation could hinder the adoption of new technologies and business models.

– Bureaucracy and costs: Too many rules can create a significant bureaucratic burden for businesses, especially small and medium-sized ones. Administrative formalities and compliance costs can be prohibitive and discourage investment and growth.

Final reflection

Balance is essential. Regulation must be smart, adaptive and evidence-based. It must foster innovation without compromising safety or justice.

Innovation and flexibility:

– Concrete examples: Historically, innovation has flourished in environments where restrictions were minimal. Silicon Valley, for example, has become an epicentre of innovation thanks to its culture of experimentation and its emphasis on business flexibility. Start-ups and large corporations alike have developed disruptive technologies, such as search engines, social networks and streaming services, in a relatively lightly regulated environment.

– The effect of regulation on creativity: Too many rules can stifle creativity and boldness. Businesses need room to test new ideas and business models without fear of excessive penalties. Autonomous vehicle companies, for instance, have faced regulatory hurdles in their drive to revolutionise mobility. Regulation must be flexible enough to allow responsible experimentation.

Bureaucracy and costs:

– Administrative burden: Businesses, especially small and medium-sized ones, are often overwhelmed by the red tape that comes with regulatory compliance. Paperwork, reporting and audits can distract entrepreneurs and drain valuable resources.

– Impact on investment and growth: High compliance costs can deter investment and business expansion. Companies may decide not to innovate or expand because of the financial and administrative burden, and this could harm the economy as a whole.

Safety and protection:

– Historical examples: Regulation has been crucial in protecting consumers and the environment. Rules such as competition law, food safety regulations and data privacy standards have prevented abuse and harm.

– Risks without regulation: Without regulation, we could face unfair commercial practices, monopolies and systemic risks. The 2008 financial crisis, for example, revealed the need for stricter supervision of the banking sector.

Ultimately, the EU must strike a balance between promoting innovation and protecting the public interest. Smart regulation must be agile, data-driven and able to adapt to technological change. Only then can we achieve a strong Europe that is both an ‘innovation superpower’ and a champion of safety and fairness.

Antonio Tejeda Encinas, President of the Euro-American Committee of Digital Law - CEA Digital Law As a lawyer specialising in European affairs, I am pleased to share my view on the recent joint statement issued by a number of European companies and associations.
