President of the Euro-American Committee on Digital Law – CEA Digital Law

In the context of the digital age, corporate social responsibility (CSR) has become even more relevant. Before examining how CSR applies in the online environment, it is important to recall what the concept entails and why it matters so much in business.

CSR extends across the different areas of a company’s management. Its main objective is to reduce the negative impact that multinationals and other companies may create, in keeping with the need to manage the effects of their activities on social, labor, environmental and human rights. This means considering how their actions affect customers, employees, shareholders, local communities, the environment and society as a whole.

Five guiding principles shape the development of CSR:

1. Compliance with the law: Companies must comply with the laws and regulations in force in every jurisdiction in which they operate.

2. Global, cross-cutting approach: CSR cannot be limited to a specific field; it must be addressed holistically and encompass every area of the company.

3. Ethics and consistency: Business ethics must permeate every decision and action, ensuring consistency between stated values and actual conduct.

4. Impact management: Companies must identify and responsibly manage the effects their activities have on the different stakeholders involved.

5. Meeting expectations and needs: CSR seeks to meet the expectations and needs of stakeholders, including employees, customers, suppliers and the wider community.

In a society undergoing constant change and digital transformation, however, the question arises of how social responsibility should be applied in this new context.

The internet plays a fundamental role in today’s digital world. Before discussing Digital CSR specifically, it is essential to consider the need for a digital-responsibility law involving society as a whole. With the internet in widespread use, restrictions and guidelines that promote ethical and responsible coexistence are essential. Digital responsibility does not rest solely with companies; it is shared by every user. The visibility and permanence of online information make individual and social ethics and responsibility fundamental.

The adoption of new technologies has transformed how companies communicate with their stakeholders. One-way communication predominated in the past, but real-time, two-way interaction with different groups is now possible. Social media have changed the dynamics of communication, allowing companies to receive feedback and valuable information from the community.

This context has given rise to the concept of “open source branding,” which highlights the importance of interaction between a company and its stakeholders in co-creating the brand. Social media become a key setting for this interaction because they enable closer, more transparent communication.

Effective communication of Digital CSR requires consideration of every stakeholder’s needs and an assessment of possible solutions based on three criteria: whether they satisfy the need being addressed, whether they align with the company’s activities, and whether they are internally and externally consistent.

It is important to emphasize that CSR is not the responsibility of only one department or specific area of a company; it must be embraced at the highest level of management and integrated into the organizational culture. CSR must form part of the core values that characterize the organization’s identity, reflected in its vision, mission, values, commitments and strategies.

Digitalization has revolutionized corporate transparency and reputation management. Technological innovation has enabled data to be opened up (Open Data) and put to use (Big Data), providing tools for presenting results transparently. It has also fostered the co-creation of projects and the development of simple mobile platforms that facilitate access to relevant information.

CSR goes beyond isolated social initiatives; it seeks to integrate responsibility into business strategy. Meeting stakeholders’ demands is an opportunity to create competitive advantages and contribute to social well-being.

In conclusion, social media have accelerated the spread of Corporate Social Responsibility, increasing visibility and interaction with stakeholders. Digital transformation represents an opportunity to develop responsible and sustainable CSR by harnessing technology to deliver value and transparency. With their power and influence, companies have the potential to create positive change in the world. Digital innovation thus becomes a powerful ally for CSR and for advancing a more responsible and ethical future.
