This regulatory milestone, designed to address the challenges posed by illegal online content and ensure the protection of consumer rights, marks a new chapter in the regulation of digital platforms.

The DSA, an ambitious European Union initiative, reshapes the landscape of online responsibility by establishing a series of clear obligations for digital service providers, from social media giants to search engines and online marketplaces. These obligations go beyond simply removing illegal content; they require transparency in content moderation, attention to data protection and user safety, and a proactive approach to tackling issues such as hate speech and disinformation.

One of the DSA’s main provisions is the requirement for digital service providers to designate specific points of contact for authorities and users, making direct communication easier when problems arise. Online platforms must also provide clear and understandable information about their content-moderation practices, as well as periodic reports on these activities. This not only promotes transparency but also empowers users by giving them a clearer view of how online content is managed.

But the DSA does not stop there. It also imposes additional obligations on online platforms, including implementing internal complaint-management systems, facilitating out-of-court dispute resolution and protecting minors online. These measures are intended to create a safer and more transparent digital environment for all users, especially those who are most vulnerable.

However, compliance with the DSA is not merely a matter of following new rules. There are also significant consequences for those that fail to meet these obligations. Fines for non-compliance can reach up to 6% of a company’s worldwide annual turnover, underscoring the seriousness with which these regulations are enforced.

In short, the DSA represents an important step toward a safer and more transparent internet for everyone. By setting clear standards and imposing significant consequences on those that fail to meet them, this legislation has the potential to transform how we interact and engage online.

Antonio Tejeda Encinas President of the Euro-American Committee on Digital Law – CEA Digital Law The digital world took a step forward when the Digital Services Act (DSA) entered into force on Saturday, February 17, 2024.
