A significant case in the United Kingdom illustrates this use: a law firm obtained judicial approval to employ an NFT on a blockchain to serve notice on the alleged perpetrators of a cryptocurrency theft. This accelerated the legal proceedings by enabling the court to summon the alleged fraudsters, who had previously remained anonymous.

Since 2022, the United States has seen increased use of NFTs to serve defendants in blockchain-related cybercrime cases, making it possible to reach alleged perpetrators who could not previously be located. This phenomenon reflects a global rise in cybercrime, including crypto-asset theft, as shown by data from Spain’s Ministry of the Interior recording an increase in computer fraud.

Courts abroad have turned to the very technology used by cybercriminals, such as NFTs, to overcome obstacles in the service of court documents and ensure that defendants actually receive the allegations against them. In doing so, they address the risk of denying defendants a proper defense, as well as other jurisdictional and communication challenges. One example is a US federal judge who served court documents through blockchain and NFTs after an expert report confirmed unlawful cryptocurrency transactions.

NFTs, which emerged through the evolution of cryptographic tokens, are unique and indivisible, allowing them to serve as publicly verifiable certificates. Because blockchains are distributed, encrypted and public, they are ideally suited to applying precise timestamps, guaranteeing content integrity and authenticating senders and recipients in communications.

In summary, distributed-ledger technology, together with NFTs, offers an efficient and legally robust solution for the service of court documents in the digital age, consistent with the principles of authenticity and the protection of fundamental rights. This innovative approach helps improve the effectiveness and legitimacy of the justice system in an increasingly digital environment.

Antonio Tejeda Encinas , CEO Meta Channel Corp The application of distributed-ledger technology, particularly through NFTs, stands out as an effective tool for electronic service because of its immutability, transparency and security.
